IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.20381 of 2026 Prasanna Kumar Panda …. Petitioner Mr. Sibasis Samantaray, Advocate -versus- State of Odisha and Others …. Opp. Parties Mr. S. B. Panda, AGA CORAM: THE HON’BLE MR. JUSTICE CHITTARANJAN DASH ORDEROrder No. 08.07.2026 01. 1. Heard learned counsel for the parties. 2. Learned counsel for the Petitioner submits that the Petitioner intends to prefer an appeal under Section 12 of the Odisha Survey and Settlement Act, 1958 against the publication of the Record-of-Rights/Map. However, the grievance of the Petitioner is that the appeal is not being entertained by the competent authority. 3. Learned Additional Government Advocate submits that appeals against such publication were being entertained till August, 2025, but not thereafter. 4. Learned counsel for the Petitioner submits that unless the appeal is entertained and considered on merits, the Petitioner would suffer serious prejudice, as his valuable rights are likely to be affected by the publication. 5. Having heard learned counsel for the parties and having regard to the nature of the grievance, this Court is of the view that the ends of justice would be met by permitting the Petitioner to avail the statutory remedy.
Accordingly, the writ petition is disposed of granting liberty to the Petitioner to file an appeal under Section 12 of the Odisha Survey and Settlement Act, 1958 before the competent appellate authority within ten (10) days from today. In the event such appeal is accompanied by an application for condonation of delay, the appellate authority shall consider and dispose of the application for condonation of delay in the first instance, and, if the delay is condoned, shall proceed to consider the appeal on its own merits, all in accordance with law. 6. It is made clear that this Court has not expressed any opinion on the merits of the case and all contentions of the parties are kept open.
