Brahma, ASC ABLAPL No.5643 of 2026 Riaz Mahammed @ Sahil @ Riyaz …. Petitioner Mahammad Mr. A.R. Panda, Advocate -Versus- State of Odisha …. Opposite Party Mr. S.K. Brahma, ASC And ABLAPL No.5644 of 2026 Hasan Khan @ Kunu …. Petitioner Mr. A.R. Panda, Advocate -Versus- State of Odisha …. Opposite Party Mr. S.K. Brahma, ASC CORAM: MR. JUSTICE R.K. PATTANAIK ORDEROrder 06.07.2026No. 03. 1. All the ABALPLs are taken up together for orders. 2. Heard learned counsel for the respective parties. Page 1 of 3 3. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Baramba P.S. Case No.154 of 2026 corresponding to G.R. Case No.522 of 2026 pending in the file of learned J.M.F.C., Baramba on the grounds stated.
4. Since the petitioner in ABLAPL No.5644 of 2026 is arrested in the meantime, recording such submission of Mr. Panda, learned counsel appearing for him, the same is dismissed as a result being infructuous. With respect to the other two petitioners, it is informed to the Court by Mr. Panda, learned counsel that the accused, namely, Jabar Khan is having one antecedent, whereas, the accused, namely, Riaz @ Mahammed @ Sahil @ Riyaz Mahammad has four criminal cases of similar nature. Referring to the FIR as at Annexure-1, it is submitted that the cows were found in the garden area of one Fakhir Behera of the village but instead the petitioners have been roped in by the local police with the lodging of the FIR by the informant. It is claimed that the said villager has not been examined by the police instead the petitioners have been framed falsely. Recorded the objection of the State with reference to the report claiming that it is a Syndicate and the accused persons are responsible for the transportation of cattle illegally. Considering the submissions as and though the petitioners are having antecedents but since an attempt was made to transport only seven cattle and it has been intercepted before such transportation, this Court is inclined to direct both of them to surrender before the learned court below for being Page 2 of 3 released with stringent conditions even if their bail plea is not entertained. 5. Accordingly, it is ordered.
6. In the result, the ABLAPLs are disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C., Baramba within a fortnight from today in connection with G.R.
