IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.6007 of 2026 Rinku Pradhan & another …. Petitioners Mr. J. Sahoo, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. K. Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK ORDEROrder 02.07.2026No. 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Gangapur P.S. Case No.195 of 2026 corresponding to G.R. Case No.727 of 2026 pending in the file of learned J.M.F.C., Aska on the grounds stated. 3. Perused the FIR as at Annexure-1. Mr. Sahoo, learned counsel for the petitioners submits that all the offences are bailable in nature except the one under Section 74 BNSS and hence, considering the same, the petitioners should be directed to go on bail. Mr. Lenka, learned ASC for the State informs the Court that the petitioners do have antecedents. But considering the circumstances under which the alleged occurrence took place and described in the FIR as at Annexure-1, it is made to reveal that there was push and pull between the parties and in course of events, it has led to the outraging of modesty of Page 1 of 2
informant’s mother. In view of the above and recording the submissions of learned counsel for the respective parties, though the petitioners do have antecedents and the informant is shown to have received simple injuries as further informed by Mr. Lenka, learned ASC, this Court, though not in favour of entertaining their bail plea but is inclined to direct them to surrender before the learned court below for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C., Aska in connection with G.R. Case No.727 of 2026 corresponding to Gangapur P.S. Case No.195 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount with such other conditions imposed with an additional condition that both shall furnish an undertaking at the PS not to commit any further mischief involving the informant and his other family members in any manner whatsoever, while on bail. 6.
