SATAPATHY DATE OF HEARING & DATE OF JUDGMENT:01.07.2026 (ORAL) G. Satapathy, J. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Sinapali PS Case No.130 of 2025 corresponding to S.T. Case No. 243 of 2025 (CT Case No.130 of 2025) pending in the file of learned Addl. District & Sessions Judge, Khariar for commission of offences punishable U/Ss. 103(1)/ 238/61(2)/3(5) of the BNS, on the main allegation of committing murder of one Lagnia Sunani, along with co-accused persons. BLAPL No.1737 of 2026 Page 1 of 4 2. Heard, Mr. Gyanendra Chandra Swain, learned counsel for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record.
3. After having considered the rival submissions upon perusal of record, it appears from the record that there was alleged quarrel between the deceased Lagnia Sunani and co-accused Keshaba Nagesh on 29.04.2025, but the said deceased Lagnia Sunani went missing since 13.05.2025, however, the dead body of the deceased was recovered on 21.05.2025 and accordingly, UD case No. 06 of 2025 was registered. In the course of enquiry in UD case, it was ascertained that the Petitioner and others had allegedly killed the deceased by entering into conspiracy. The implication of the present Petitioner in this case is on the basis of her statement before the Police recorded U/S. 23(2) of BSA and recovery of the mobile phone of the deceased, but it is alleged that the deceased was having illicit affairs with the Petitioner. The materials on record disclose allegation against the husband of the Petitioner and others to have killed the BLAPL No.1737 of 2026 Page 2 of 4
deceased, but the Petitioner has been alleged to have called the deceased to a spot. The Petitioner is a lady and she is in custody since 24.05.2025, but the trial is yet to commence. Further, no material has been collected to indicate that the Petitioner would abscond in the event of her enlargement on bail. Besides, the Petitioner is also having children in her house. In the aforesaid facts and situation and taking into account the alleged role played by the Petitioner and there being little apprehension against the Petitioner for tampering with the prosecution materials because of submission of charge sheet in the meantime, this Court without expressing any view on merit admits the petitioner to bail. 4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-BLAPL No.1737 of 2026 Page 3 of 4
(i) The petitioner in the course of trial shall attend the trial Court on each date of posting without fail unless his attendance is dispensed with. In case the Petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S.269 of BNS, 2023 in accordance with law. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
