IN THE HIGH COURT OF ORISSA AT CUTTACK CMP No.818 of 2026 Pradipta Mohanty and others ..... Petitioners Represented by Adv.- Ms. Namita Pattnaik -versus- State of Odisha and others ..... Opposite Parties Represented by Adv.- Mr. S.K. Parhi, ASC CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 30.06.2026 Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard the learned counsel for the Petitioners. Perused the CMP application as well as the prayer made therein. 3. By filing the present CMP application under Article 227 of the Constitution of India, the Defendants in Civil Suit No.16 of 2017 pending in the court of the learned Civil Judge, Junior Division, Aul, have approached this Court for a direction to the learned trial court to expedite the trial in the civil suit and dispose of the same in a time bound manner. 4. Learned counsel for the Petitioners-Defendants, at the Page 1 of 1.
outset, contended that being aggrieved by delay in disposal of Civil Suit No.16 of 2017 pending in the court of learned Civil Judge, Junior Division, Aul, the Petitioners have approached this Court by filing the present CMP application under Article 227 of the Constitution of India. She further submitted that the suit is of the year 2017 and that the same is pending for almost 9 years. She further submitted that the suit has not progressed substantially, causing harassment to the Petitioners-Defendants. In such view of the matter, learned counsel for the Petitioners contended that the learned trial court be directed to expedite the hearing of the suit and the suit be disposed of in a time bound manner. 5. On perusal of the record, it appears that the suit is of the year 2017. Although the suit has been filed with a prayer for declaration of right, title, interest and possession over the suit land, however the same is likely to take considerable time to be decided. Further, this Court is also aware of the fact that several year old cases are pending in the civil courts in the State of Odisha. Therefore, it would not be fair to give any specific direction for disposal of the suit in a time bound manner. 6. However, taking into consideration the submission made by the learned counsel for the Petitioners that the suit is pending since 2017, liberty is granted to the Petitioners to Page 2 of 2.
move an application before the trial court for early disposal of the aforesaid suit. Subject to cooperation of the counsels of the parties, the trial court shall make every endeavour to dispose of the suit as expeditiously as possible. 7. With the aforesaid observation and direction, the CMP stands disposed of. (A.K.
