Opposite Party Mr. S. K. Lenka, ASC And ABLAPL No.6632 of 2026 Ashrumochan Pradhan …. Petitioner Mr. B. P. Chhualsingh, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. K. Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK ORDER 29.06.2026 Order No. 02. 1. All the ABLAPLs are taken up for orders. 2. Heard learned counsel for the respective parties. 3. Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Delanga Page 3 of 6 P.S. Case No.120 of 2026 corresponding to G.R. Case No.375 of 2026 pending in the file of learned J.M.F.C., Pipili on the grounds stated therein. 4. Perused the FIR as at Annexure-1.
5. The learned counsels for the petitioners submit that the accused persons committed the excess during the alleged incident under the impression that the two of the police officials, who had been to the spot on an enquiry, to be being thieves and hence, assaulted them. It is submitted that thereafter the police party arrived and the other events followed and the claim is that none of the members of the police force received any serious injury. Mr. Lenka, learned ASC for the State, however, submits that the accused persons committed the overt acts and not only that, they assaulted the informant and others on duty. It is however informed to the Court that some of the accused persons arrested immediately after the alleged incident are on bail, hence, the petitioners should be released with conditions. Some of the petitioners are said to have antecedents, as further informed. 6. The FIR reveals that the police party was attacked by large number of people. It has been alleged therein that nearly 200 persons allegedly assaulted the informant and other police officials by kicks and fist blows. The case diary is produced by Mr. Lenka, learned ASC for the State along with statements of witnesses recorded during investigation. The medical examination reports are also made available along with the case Page 4 of 6 diary. On perusal of the said reports, it is made to understand that the victims received injuries but stated to be simple in nature received on account of blunt force.
7. Considering the above facts and submissions of learned counsel for the respective parties and recording the plea that the police on duty though attacked, none of them received any serious injury for the alleged assault and the FIR revealing the involvement of nearly 200 persons and allegedly the mischief was committed under the impression that the police officials who had been to the village are thieves, this Court though not in favour of entertaining their bail plea, however, is inclined to direct their release upon surrender with stringent conditions imposed. 8. Accordingly, it is ordered. 9. In the result, all the ABLAPLs are disposed of. It is directed that in the event, the petitioners surrender before the learned J.M.F.C., Pipili in connection with Delanga P.S. Case No.120 of 2026 corresponding to G.R. Case No.375 of 2026 within a fortnight from today, they shall be released on bail on furnishing bail bonds of Rs.20,000/-(twenty thousand only) each with one solvent surety each for the like amount and such other terms and conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, none of them shall involve themselves in similar criminal activities while on bail and to furnish an undertaking at the local PS in that regard and also to co-operate the IO in the investigation without default as and when summoned.
