IN THE HIGH COURT OF ORISSA AT CUTTACK CMP No.716 of 2026 Bank of India, Kharvela Nagar ..... Petitioner Branch, Bhubaneswar Represented by Adv. - Sibadutta Ramaprasad Mishra -versus- Rashmi Rani Panigrahi & Ors. ..... Opposite Parties Represented by Adv. - CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 29.06.2026 Order No. 03. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein. 3. By filing the abovenoted CMP application the Defendant No.7 which is a Nationalised Bank has approached this Court with a prayer for early disposal of the C.S. No.57 of 2019 pending in the Court of learned Civil Judge, (Sr. Division), Kodala. 4. Learned counsel for the Petitioner at the outset contended that the Opposite Parties as plaintiff filed a suit for declaration and partition in which the present Petitioner has been arrayed as Page 1 of 2. Defendant No.7. He further contended that although the suit was filed in the year 2019, however, the same is still pending. Being aggrieved by the delay in disposal of the suit, the Defendant No.7-Bank, has approached this Court by filing the present CMP application for a direction to the learned trial court to expedite the trial and to conclude the same within a stipulated period of time.
5. Considering the submissions made by the learned counsel for the Petitioner, further taking note of the background facts of the present case and considering the fact that the suit is of the year 2019, this Court is not inclined to fix any specific time limitation for disposal of the suit. This is moreso as many year-old cases are pending before the learned trial court for consideration. However, taking into consideration the submission made by the learned counsel for the Petitioner, he is granted liberty to approach the learned trial court by filing an application for an early disposal of the suit. In the event any such application is filed, the learned trial court shall make every endeavour to consider and dispose of the suit as expeditiously as possible, subject to his convenience and the pendency of the cases before the Court. 6. With the aforesaid observation and directions, the CMP application stands disposed of. (A.K. Mohapatra) Judge Rubi Signature Not Verified Digitally Signed Page 2 of 2.
