IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.4925 of 2026 Purna Chandra Pradhan … Petitioner Mr. B.R. Das, Advocate -versus- State of Orissa … Opposite Party Mr. P. Satpathy, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL)23.06.2026 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is an application U/S.483 of BNSS Act by the petitioner for grant of bail in connection with PR No.212 of 2025-26 corresponding to SC Case No.31 of 2026 pending in the Court of learned 2nd Addl. Sessions Judge, Berhampur for commission of offences punishable U/S. 20(b)(ii)(C) in contravention of Sec.8(C) of the NDPS Act, on the main allegation of possessing net weight 20Kgs of Contraband Ganja. 3. Heard, Mr. Biswaranjan Das, learned counsel for the petitioner appearing virtually and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record. 4. Admittedly the petitioner has been detained in custody since 06.03.2026 and in the meantime final PR has already been submitted, but the quantity of contraband ganja seized in this case is allegedly 20Kgs which is the threshold limit of commercial quantity inasmuch as any quantity more than 20Kgs of Page 1 of 2
Contraband Ganja is considered to be commercial quantity and thereby the provision of Sec.37 of NDPS Act being not attractable to the present case. In the aforesaid facts and situation and taking into consideration the nature and gravity of the offence as alleged against the petitioner and the petitioner being claimed to have no criminal antecedent of similar nature, this Court without expressing any view on merit admits the Petitioner to bail. 6. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 7. Accordingly, the BLAPL stands disposed of. 8. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
