IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.12970 of 2025 Sujel Golap … Petitioner Mr. A. Mishra, Advocate -versus- State of Orissa and another … Opposite Parties Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL)23.06.2026 05. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Jeypore Town PS Case No.364 of 2025 corresponding to TR Case No.83 of 2025 pending in the file of learned Addl. Sessions-cum-Special Court under POCSO Act, Jeypore, Dist-Koraput for being charge sheeted for commission of offences punishable U/Ss. 64(2)/351(2)/351(4)/115(2)/3(5) of BNS r/w Section 6 of POCSO Act, on the main allegation of committing rape and aggravated penetrative sexual assault upon the victim by assaulting her. 2. Heard, Mr. Arijeet Mishra, learned counsel for the petitioner and Mr. M.R. Patra, learned Addl. PP in the matter and perused the record. None appears for the victim despite being duly informed as apprised by learned Addl. PP. 3. Mr. Arijeet Mishra by producing certain documents brings it to the notice of the Court that the father of the victim has earlier lodged an FIR against the Petitioner for kidnapping the victim, but the victim in her statement before the Magistrate in the said case is stated to have eloped with the Petitioner and she had gone to the Petitioner in her own volition. Now again, another case has been registered against the Petitioner on the report of the Page 1 of 2
father of the same victim for the allegation indicated above, but the statement of the victim has already been recorded in this case. Besides, the Petitioner is stated to be aged about 19 years and he is in custody since 24.10.2025 and in the meantime, charge sheet has already been submitted. In the aforesaid facts and situation and taking into account the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusation sought to be brought against him and regard being had to the materials placed on record together with the statement of the victim and keeping in view the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit admits the petitioner to bail. 4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. Signature Not Verified
