IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.4967 of 2026 Pradeep Jal … Petitioner Mr. S. Mohanty, Advocate -versus- State of Orissa … Opposite Party Mr. M.R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL):23.06.2026Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Ainthapali PS Case No.256 of 2024 corresponding to ST Case No.424/02 of 2024-25 pending in the file of learned Additional Sessions Judge-cum-PO-OPID, Sambalpur for commission of offences punishable U/Ss.103(1)/61(2)(a)/3(5) of the BNS, on the main allegation of committing murder of the deceased Amit Singh by assaulting and stabbing him, along with co-accused persons in furtherance of their common intention. 3. Heard, Mr. Surendra Mohanty, learned counsel for the petitioner appearing virtually and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record. 4. No doubt, it is advanced for the Petitioner that the name of the present Petitioner does not find place in the FIR, but eye witnesses like Chintu Bagarty, Page 1 of 2
Ranjan Nayak, Bikash Taria and Ajaya Behera have named the Petitioner to be allegedly present at the scene of occurrence, however, all the eye witnesses are yet to be examined. Further, the deceased in this case had suffered homicidal death which is evident from the postmortem report of the deceased. In view of the aforesaid facts and circumstances and taking into account the nature and gravity of the offences as alleged against the petitioner vis-a-vis the accusations sought to be brought against him and regard being had to the materials placed on record and last but not the least, keeping in view the examination of the eye witnesses still being awaited, this Court is not inclined to grant bail to the petitioner. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter. (G.
