IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.6942 of 2026 Giridhari Parida & another …. Petitioners Mr. A. Das, Advocate -Versus- State of Odisha & another …. Opposite Parties Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK ORDER Order 22.06.2026 No. 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Gondia P.S. Case No.34(2) of 2011 corresponding to G.R. Case No.333 of 2011 arising out of 1CC Case No.121 of 2013 pending in the file of learned J.M.F.C., Gondia on the grounds stated. 3. Perused the FIR and complaint as at Annexures-1 and 2 respectively. Recorded the submission of Mr. Das, learned counsel for the petitioners. It is submitted that the FIR lodged in connection with the case resulted in the submission of final report dated 5th October, 2012. It is further submitted that subsequent to the final report received, a protest petition was entertained and registered as 1CC Case No.121 of 2013 and therein, NBWAs have been issued against the petitioners, hence, their apprehension of arrest by the local police. claimed that the informant filed an affidavit before the learned court below claiming amicable settlement between the parties. A copy of the said affidavit is at Annexure-4. With the above submission, Mr. Das, learned counsel claimed release of the petitioners upon their surrender before the learned court below pending execution of NBWAs. Recorded the objection of the State. It is informed that the coercive action has been taken by the learned court below recently. Considering the fact that the complaint is pending disposal since 2013 and therein, NBWAs have been issued and hence, the petitioners apprehend arrest in connection with the case which initially turned to a final report, this Court, though not in favour of entertaining any such plea of pre-arrest bail, however, is inclined to direct both of them to surrender before the learned court below for being released with suitable conditions imposed considering the compromise affidavit filed before the court below as per Annexure-4. 4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C., Gondia within a fortnight from today in connection with G.R. Case No.333 of 2011 arising out of 1CC Case No.121 of 2013 corresponding to Gondia P.S. Case No.34(2) of 2011, they shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case.
