Since all the ABLAPLs relate to the same FIR, on the consent of the learned counsel for the Petitioners and learned counsel for the State, they are taken up together and are disposed of by this common order. 2. Heard learned counsel for the Petitioners and learned counsel for the State. 3. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.569 of 2025 pending on the file of learned J.M.F.C., Hatadihi arising out of Nandipada P.S. Case No.343 of 2025 for commission of offences punishable under Sections 303(2)/ 305(e)/ 317(2)/ 111/ 3(5) of BNS read with Section Page 2 of 4 51(1)(i) of Orissa Minor Minerals Concession Rules, 2023.
4. It is submitted by the learned counsel for the Petitioner that the Petitioners have been falsely implicated in cases of similar nature and considering the same, they may be protected by pre-arrest bail. 5. Learned counsel for the State on the other hand opposes the prayer for pre-arrest bail and submits that since the Petitioners are indulging in commission of offences with impunity, they have been arrayed as accused and also rebuts the allegations of false implication. 6. The instructions regarding antecedents of the Petitioners are taken on record. 7. Considering the nature of allegations in the light of the rival submissions, this Court is not inclined to entertain this application for pre-arrest bail. However, it is directed that the Petitioners may surrender before the learned J.M.F.C., Hatadihi in connection with the aforementioned case within one month from today. In the event of his surrender and motion for bail, the same be considered by the learned J.M.F.C., Hatadihi on merits, in the first hour of the day. Page 3 of 4 In the event of rejection of the prayer for bail by the learned J.M.F.C., Hatadihi, the Petitioners are at liberty to move the higher forum for bail in the second hour on the same day.
8. On being so moved, the higher forum is requested to make an endeavor to dispose of the bail application of the Petitioners on the same day. The case diary shall be made available to the concerned courts to facilitate disposal of the bail application of the Petitioners and learned J.M.F.C., Hatadihi is called upon to transmit the case record to the higher forum in the second hour expeditiously in the event of rejection of the bail application by him. 9.
