NARASINGH ORDER 19.06.2026 Order No. 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.404 of 2026 pending on the file of learned J.M.F.C., Chandbali, Dist-Bhadrak, arising out of Chandbali P.S. Case No.218 of 2026 for commission of offences punishable under Sections 303(2)/317(2)/3(5) of BNS, 2023. 3. It is submitted by the learned counsel that the Petitioner was intimated to deposit a sum of Rs.4,00,000/- towards compounding of the alleged offence relating to unauthorized transportation of minor minerals (sand). Since he is not been able to Page 1 of 2 deposit the same, he has facing imminent threat of arrest. Hence, he seeks pre-arrest bail. 4. Learned counsel for the State opposes the prayer for pre-arrest bail in view of the communication from the junior mining officer intimating the penalty towards compounding adverted to hereinabove. 5. It is stated at the bar that the Petitioner does not have any criminal proclivity. 6. Considering the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

7. It is needless to state here that the release of the Petitioner on pre-arrest bail will have no bearing on the penalty as fixed in the notice issued from the Junior Mining Officer. 8.
