CRP No.4879 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 19-08-2026 CORAM THE HON'BLE MR JUSTICE N. ANAND VENKATESH Civil Revision Petition No.4879 of 2026 and C.M.P.No.21327 of 2026 S.Srinivasan S/o.Late Sanmugam ..Petitioner Vs 1. G.R.Praveena W/o.R.Ramsundar Represented by Power of Attorney Agent, G.Ramana 2. M/s.Sri Ramakrishna Property Management, represented by R.Ashok Kumar, S/o.V.Ravi, Having office at No.275, Third Cross Street, Eari Scheme Road, Mogappair East, Chennai - 600 037. 3. R.Ashok Kumar S/o.V.Ravi ..Respondents Civil Revision Petition filed under Article 227 of the Constitution of India praying to strike off R.L.T.O.P.No.24 of 2026 on the file of the District Munsif Court, Ambattur. For Petitioner : Mr.T.Arunkumar ***** __________ Page1 of 4 https://www.mhc.tn.gov.in/judis CRP No.4879 of 2026 ORDER This civil revision petition has been filed seeking to strike off R.L.T.O.P.No.24 of 2026 on the file of District Munsif Court, Ambattur. 2. Heard learned counsel for petitioner and carefully perused the materials available on record. 3. The main ground urged by learned counsel for petitioner is that there is absolutely no landlord and tenant relationship between the parties and the same is evident from the manner in which the written statement was filed by the first respondent in the suit filed in O.S.No.32 of 2023. In view of the same, the proceedings itself are unsustainable and the same has to be struck off.
4. In the considered view of this Court, the jural relationship of a landlord and tenant cannot be decided in a civil revision petition. It is the defence that has been taken by the petitioner and it has to be established before the Court below. In view of the same, considering the limited scope of interference in the proceedings, which are already summary in nature, this Court is not inclined to exercise its jurisdiction. The question is left open and the petitioner can raise this issue before the Court below and the same will be considered on its own merits in accordance with law. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis CRP No.4879 of 2026 This Civil Revision Petition is disposed of in the above terms.
