2. When the first petition was filed in Crl.M.P(MD)No.46 of 2025, this Court had found that the petitioner has failed to make out a prima facie case and the Court also found that it is not a fit case for grant of suspension of sentence. Accordingly, the said petition was dismissed by order dated 12.12.2025. Subsequently, the petitioner has moved another petition in Crl.M.P(MD)No. 2553 of 2026. When the Court was about to dismiss the petition on merits, the learned counsel sought permission to withdraw the petition. Accordingly, it was dismissed as withdrawn by order dated 05.02.2026. Thereafter, on third time, the petitioner moved another petition in Crl.M.P(MD)No.5821 of 2026. This Court, finding that there is no change of circumstances to entertain the said petition, has by order dated 16.03.2026, dismissed the said petition. However, since the paper book has already been made ready, this Court directed the Registry to include the appeal in the advance list. 3. In view of the above, we do not find any merits in this petition. Hence, this Criminal Miscellaneous Petition is dismissed.
