CRL OP No. 9924 of 2026 Prayer: Criminal Original Petition filed under Section 528 of BNSS, to call for the records in Crime No.437 of 2025 on the file of the Inspector of Police, __________ Page2 of 6 https://www.mhc.tn.gov.in/judis CRL OP Nos. 18084 & 9924 of 2026 Ranipet Police Station, Ranipet District to quash the same or pass any other order such orders deem fit to the facts and circumstances of this case and thus render justice. For Petitioner(s): Mr.S.Suresh in both petitions For Respondent(s): Mr.R.Rajasekaran in both petitions Government Counsel (Crl. Side) for R1 Common Order
The Criminal Original Petition in Crl.O.P.No.18084 of 2026 seeks to quash Crime No.438 of 2025 on the file of the Inspector of Police, Ranipet Police Station, Ranipet District for the alleged offences under Sections 296(b), 115(2), 351(2) of BNS and the Crl.O.P.No.9924 of 2026 seeks to quash Crime No.437 of 2025 on the file of the Inspector of Police, Ranipet Police Station, Ranipet District for the alleged offences under Sections 296(b), 118(1) & 351(3) of BNS , on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further. 2. The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.p.c. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the __________ Page3 of 6 https://www.mhc.tn.gov.in/judis CRL OP Nos. 18084 & 9924 of 2026 Hon’ble Supreme Court of India in Gian Singh -Vs- State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments. 3. The background facts in which the case and counter arise is that on account of the dispute within the political party between two sections, a quarrel is said to have arisen, leading to the registration of the cases. Now the parties have ironed out the differences in both case and counter.
4. Thus, it can be seen that this matter is a fit case for the exercise of extraordinary jurisdiction to quash the case on compromise. 5. Accordingly, these Criminal Original Petitions are allowed. The Crime Nos.437 & 438 of 2025 on the file of the 1st respondent / Inspector of Police, Ranipet Police Station, Ranipet District shall stand quashed.
