PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, transferring the investigation in Crime No. 50 of 2026, presently pending on the file of the 1st Respondent, to a competent Central Investigating Agency, so as to ensure a fair, impartial, and independent investigation, since the matter involves the life and personal liberty of the Petitioner’s son, Mr.Kalimuthu @ Vellai Kali and to direct the said agency to file its final report within a stipulated time frame. For Petitioner : Mr.M.G.Martinmanivannan For Respondents : Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) O R D E R This Writ Petition has been filed for transfer of investigation in Crime No.50 of 2026 from the file of the 1st respondent to the file of the competent Central Investigation Agency. 2. Heard the learned counsel appearing on either side and perused the materials available on record. 2/7 https://www.mhc.tn.gov.in/judis W.P.Crl.No.1668 of 2026
3. The petitioner’s son is convicted and confined at Central Prison -1, Puzhal, Chennai. He is also facing trial for other cases. While he was taken to attend the hearing in C.C.No.267 of 2020 on the file of the II Additional Special Judge, Special Court for NDPS Act Cases, Madurai, within the jurisdiction of 1st respondent, some unknown persons had thrown country bombs on their vehicle and due to which, two police persons sustained injuries and fortunately, the petitioner’s son escaped without any injury. On the complaint, the 1st respondent registered FIR in Crime No.50 of 2026. Now, the investigation is pending on the file of the 1st respondent. While pending investigation, the petitioner who is being mother of one of the victim sought for transfer of investigation from the file of 1st respondent to any other Central Investigation Agency on the ground that the petitioner’s son apprehends threat from the co-prisoners and at the hands of the 4th respondent. 4. In fact, during investigation, some of the inmates of prison only gave information about the petitioner’s son who was taken to the trial Court at Madurai. However, the 1st respondent did not conduct proper investigation and failed to implead the persons, who had given lead to the other accused persons to attack the petitioner’s son. Therefore, if the investigation 3/7 https://www.mhc.tn.gov.in/judis W.P.Crl.No.1668 of 2026
continuous on the file of the 1st respondent, the petitioner’s son would not get fair investigation. 5. The learned counsel appearing for the petitioner submitted that there is a specific direction not to produce the petitioner’s son to the Trial Court since he faces threat at the hands of the other accused persons. Even then the petitioner’s son was wantonly taken to Trial Court by vehicle. 6. The learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents, on instructions, submits that the 1st respondent almost completed the investigation since the offences registered under the Explosives Act, 1884, it requires approval from the concerned authority to file final report. That apart, the petitioner’s son is having several cases and in one case he was convicted and in some of the cases, he was facing trial. In fact, he was transferred from the Central Prison, Madurai to Central Prison-1, Puzhal, in view of the threat faced by him from other accused persons. 7. In view of the above, this Court finds no valid reason to transfer the investigation from the file of the 1st respondent to any other Central 4/7 https://www.mhc.tn.gov.in/judis W.P.Crl.No.1668 of 2026 Investigation Agency, since the 1st respondent had completed the investigation.
8. Accordingly, the Writ Petition (Criminal) is dismissed. However, the 1st respondent is directed to complete the investigation in Crime No.50 of 2026 and file a final report within a period of twelve weeks from the date of receipt of copy of this order. The 3rd respondent is directed to monitor the investigation done by the 1st respondent and must ensure that the 1st respondent comply with the order passed by this Court. It is made clear that the 1st respondent is at liberty to implead the other accused persons, if any other materials available as alleged by the petitioner’s son and also include other offences, while filing final report.
