CRL OP No. 18806 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 16-07-2026 CORAM THE HON'BLE MR.JUSTICE D.BHARATHA CHAKRAVARTHY CRL OP No. 18806 of 2026 Saravanan @ Thavalai Saravanan ..Petitioner(s) Vs The State Represented by The Inspector of Police, Sholavaram Police Station. Crime No.1122 of 2020. ..Respondent(s) Prayer: Criminal Original Petition filed under Section 528 of BNSS, to modify the condition Point No.6 i and Condition No.ii imposed in order dated 17.06.2026 in Crl.MP.No.27 of 2026 in SC.No.418 of 2024 on the file of IV Additional District Judge, Tiruvallur at Ponneri, by (i) That the Petitioner/A7 shall pay Rs.10,000/- as penalty, that is the amount of his own bond already executed. (ii) That the sureties of the Petitioner/A7 who are his mother and brother, who have executed bond for Rs.10,000/- by each shall pay each Rs.5000/- as penalty. For Petitioner(s): Mr.P.Chandrasekar For Respondent(s): Mr.R.Rajasekaran Government Advocate (Criminal Side) __________ Page1 of 4 https://www.mhc.tn.gov.in/judis CRL OP No. 18806 of 2026 ORDER This Criminal Original Petition has been filed to modify the order passed by the learned IV Additional District Judge, Tiruvallur, Ponneri dated 17.06.2026 made in Crl.M.P.No.27 of 2026 in S.C.No.418 of 2024.
2. While granting bail to the petitioner/A7, the Trial Court, while ordering the execution of the bond and surety, directed a cash security of Rs.10,000/- to be deposited by the petitioner/A7 and a cash surety of Rs.5,000/- each by the sureties. 3. Aggrieved by the same, the petitioner is before this Court. The word “penalty” shall be read as “cash surety” and it is not a penalty. As such, it is only a deposit, and it will be subject to the ultimate result of the case. The other things do not need modification. 4. The learned counsel for the petitioner submits that the amount is high, the petitioner is a daily wage earner, and he is not in a position to deposit the said amount. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis CRL OP No. 18806 of 2026 5. Upon considering the same, the total sum imposed on the petitioner and the other sureties as a cash surety is only a sum of Rs.20,000/- and therefore, it cannot be said to be an onerous condition interfering with the right to life of the petitioner. Therefore, I am not inclined to modify the amount. The impugned order, at the relevant paragraphs, shall read as “Cash Security Deposit” instead of the word “penalty”. 6. This Criminal Original Petition stands dismissed. 16-07-2026 Neutral Citation: Yes/No jas To 1.The Inspector of Police, Sholavaram Police Station. 2.The IV Additional District Judge, Tiruvallur, Ponneri. 3.The Public Prosecutor, Madras High Court. __________ Page3 of 4
