BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 06.07.2026 CORAM : THE HONOURABLE MR.JUSTICE C.V. KARTHIKEYAN and THE HONOURABLE MR.JUSTICE R.SAKTHIVEL WA.(MD)No.962 of 2026 and CMP.(MD)No.8510 of 2026 1.The Chief Educational Officer, Tenkasi District. 2.The District Educational Officer (Secondary), Tenkasi, Tenkasi District. ...Appellants Vs. 1.M.Beaula 2.The Correspondent, Amala Annai High School, Rengasamudram, Tenkasi District. ... Respondents PRAYER:- Writ Appeal filed under Clause 15 of the Letter Patent Act against the order passed in WP.(MD)No.30779 of 2024 dated 19.12.2024. For Appellant : Mr.K.K.Udayakumar Counsel for the State For Respondent : Mr.V.Paneer Selvam (R1) No Appearance (R2) 1/5 https://www.mhc.tn.gov.in/judis JUDGMENT (Judgment of the Court was delivered by C.V. KARTHIKEYAN, J.) Heard the learned Counsel for the appellant and the learned Counsel for the respondent. 2.The writ petitioner had filed the writ petition seeking to approve appointment by way of promotion with effect from 20.08.2024 and to disburse the consequential benefits.
3.The respondent was working as Secondary Grade Teacher in Punitha Arulappar Higher Secondary School, Avudayanoor and had been promoted as BT Assistant (Social Science) and appointed in the third respondent School with effect from 20.08.2024. The proposal had been sent on 27.11.2024. Seeking a mandamus to consider the said proposal, the writ petition had been filed. The learned Single Judge had issued the following directions: “4. Considering the above-said facts, the second respondent is directed to consider the proposal submitted by the management, and if the petitioner is found eligible and if the proposal has not already been returned, the same shall be forwarded to the first respondent within a period of eight (8) weeks from the date of receipt of a copy of this order. Considering the fact that the third respondent school is a minority school, the first and second respondents are directed to consider the proposal without insisting on the TET qualification.” 2/5 https://www.mhc.tn.gov.in/judis
4.The appellant is mainly aggrieved by the direction issued to the appellants to consider the proposal without insisting at TET qualification. But however, the position of law as on date with respect to minority Institutions is that the proposal has to be considered without insisting TET qualification. Now the issue is pending before a Larger Bench of the Supreme Court. 5.We would only clarify that depending upon the nature of the judgment to be delivered by the Hon'ble Supreme Court, for the present and till that time the judgment to be delivered, the TET qualification need not be insisted. The respondents have to abide by the judgement of the Ho'ble Supreme Court. 6.With the said observation, this writ appeal stands disposed of. The appellants are directed to pass necessary orders within a period of four weeks from the date of receipt of a copy of this order. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
