$~99 * IN THE HIGH COURT OF DELHI AT NEW DELHI + BAIL APPLN. 2818/2026 SEEMA KANDAR .....Petitioner Through: Appearance not given. Versus STATE OF NCT OF DELHI .....Respondent Through: Mr. Shoaib Haider, APP for the State CORAM: HON'BLE MR. JUSTICE PURUSHAINDRA KUMAR KAURAV O R D E R % 22.07.2026 1. The instant application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking grant of an anticipatory bail in relation to FIR No.329/2026 registered at PS Khyala qua offences punishable under Section 143(1)(f)/64(1)/75/127(2)/ 61(2) of Bharatiya Nyaya Sanhita (BNS). 2. The facts of the case indicate that the complainant was allegedly trafficked by co-accused Mariyam under false pretext of employment and thereafter, she was subjected to sexual abuse at the behest of co-accused Ankit and Sanju, in an intoxicated state. The said Ankit and Sanju were friends of Deepu, husband of the aforementioned co-accused Mariyam. 3. It is further alleged that the complainant was wrongfully confined and prevented from returning home despite repeated requests made to the Applicant. This is a digitally signed order. 4. Further, as indicated by the Complainant in her FIR, the applicant along with an acquaintance and co-accused Hari, transported and sold the complainant off for a sum of Rs.1,75,000/- to a co-accused Naresh Kumar, thereafter the present applicant along with co-accused Hari forcefully got her married to the said Naresh Kumar in Sikar, Rajasthan. 5. As indicated, the offence came to light after the health of the complainant deteriorated drastically after her pregnancy was detected. 6. In light of the stated allegations against the present applicant, which are found to be grave and serious in nature, the custodial interrogation of the accused may be necessary for further investigation and arresting the other accused persons. 7. Bearing in mind the seriousness of the allegations, which disclose an organised conspiracy involving multiple accused for sexual exploitation and human trafficking, the present applicant is found to be ineligible for a grant of anticipatory bail as the same may cause grave impediment in further investigation. Insofar as the allegations are concerned, grave offences are revealed affecting the bodily integrity and personal liberty of the complainant, warranting a cautious approach at the stage of bail, and in light of the same the applicant may be taken into custody and be interrogated in furtherance of the investigation, if so required. 8. With these observations, the instant application stands rejected.
9. Liberty is, however, granted to the applicant to apply for a regular bail after her surrender. PURUSHAINDRA KUMAR KAURAV, J JULY 22, 2026 Nc This is a digitally signed order.
