For Respondent/State : Mr. Rohitashva Singh, Dy. G.A. Hon'ble Shri Justice Sanjay Kumar Jaiswal Order on Board 09/07/2026 1. The accused/applicants have moved this First bail application under Section 483 of BNSS, 2023 for releasing them on regular bail during trial in connection with Crime No. 257/2025 registered at Police Station – Dabhra, District – Sakti (C.G.) for the offence punishable under Sections 103(1), 332(B), 324(6), 191(1), 191(3), 296, 115(2), 351(3), 109(1), 325 and 103(2) of BNS. 2. The prosecution case, in short, is that on 11.08.2025, complainant Kantibai Mahant, lodged information alleging that on 10.08.2025 at about 10:00 AM, the complainant’s husband Sarvedas Mahant repaired a government bore-well pump in the locality by installing a new starter. It is alleged that on the evening of 10.08.2025 at about 6:00 PM, due to an old grudge, the accused persons namely Piladas Mahant, Rohidas Mahant, Sufaldas Mahant, Chamrudas Mahant, Krishnadas Mahant, Mannudas Mahant, Kamaldas Mahant, Durjandas Mahant and Sunildas Mahant, armed with sticks, clubs and iron rods, came to the house of the complainant. They hurled obscene abuses, issued death threats, damaged the doors and windows, and forcibly entered the house. The prosecution further alleges that the accused persons assaulted Sarvedas Mahant and his son Vimaldas Mahant with kicks, sticks, clubs and rods. When the complainant intervened and took her son to safety, she was also assaulted. Thereafter, the accused persons tied the hands of Sarvedas Mahant with cloth, dragged him to the lane near Sufaldas Mahant’s house and, with common intention to cause his death, assaulted him lethally, leaving him severely injured. It is stated that while Sarvedas Mahant was being taken to Dabhra Hospital for treatment, he succumbed to his injuries at about 9:00 PM on 10.08.2025. Based on the said information, an offence has been registered against the present applicants and other co-accused persons.
3. Learned counsel for the applicants submits that the applicants have been falsely implicated in the present case. He also 3 submits that the applicants have not been named in the FIR and there is no seizure from applicant No. 2- Sevati Mahant. This Court has already granted three co-accused persons bail on the same footing; therefore, the present applicants may also be granted the benefit of bail. Applicant No. 1 - Guruwari Manikpuri is in jail since 22.08.2025 & applicant No. 2 – Sevati Mahant is in jail since 12.08.2025. Only 12 out of 37 witnesses have been examined till date; there is no likelihood of their case being decided in the near future. Therefore, the present applicants may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that it has been alleged that applicant Sevati has inflicted injury on the deceased with an iron rod and applicant Guruwari also assaulted the deceased, and there is seizure of a rope from applicant Guruwari. The applicants have been named in the Court statement of injured eye witnesses, namely Kanti Bai (PW-1) and Vimal Das (PW-2). The case of the present applicants is different from that of the co-accused, who have already been granted bail. As such, at this stage, they may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record, the evidence collected by the prosecution against the applicants and the nature of crime, at this stage, I am not inclined to release 4 the applicants on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7. However, considering the fact that the applicants are in jail since 22.08.2025 (applicant No. 1) and 12.08.2025 (applicant No. 2) and only 12 witnesses out of 37 witnesses have been examined till date, the concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible. 8. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Sanjay Kumar Jaiswal) Judge H.L. Sahu
