Sl.22 19.08.2026 Court No.6 BP C.O. 2734 of 2026 Sake Molla @ Sakerali Molla & Ors. -versus- Ajehar Ali Molla Mr. Nirmalendu Bera Ms. Gopa Das ..for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Baruipur, 24 Parganas (South) to dispose of the Title Suit No. 58 of 2024 as well as the application for injunction expeditiously. From the ordersheets appended to this application this Court finds that an application for injunction and an application for vacating the order fixing the suit for ex parte hearing are pending. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioners, C.O. 2734 of 2026 stands disposed of by requesting the learned Civil Judge (Junior 2
Division), 1st Court at Baruipur, 24 Parganas (South) to take up the hearing of the application for vacating the order fixing a suit for ex parte hearing on the next date fixed, if the same is otherwise ready for hearing, and make an endeavour to dispose of such application as expeditiously as possible without granting any unnecessary adjournments to either of the parties. The learned trial judge is further requested to make an endeavour to dispose of the application for injunction as expeditiously as possible without granting any unnecessary adjournments to either of the parties if the same is otherwise ready for hearing. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
