17.08.2026 Serial no. 54 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1681 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Hili Police Station Case No. 98 of 2025 dated 06.05.2025 u/s 20(b)(ii)(A)/21(c)/22(c)/23(c)/27(A)/28 of the NDPS read with section 27a/27(b)(ii)/27A of the Drugs and Cosmetic Act (corresponding NDPS case no. 29 0f 2025]. -And- In the matter of : Bipul Dey … … Petitioner(s) Mr. Kaushik Choudhury Mr. Dwaipayan Panda … for the Petitioner(s) Mr. Moyukh Mukherjee Mr. Arup Kumar Bhowmick … for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 225 bottles of phensedyl. The petitioner has been implicated only on the basis of statement of a co-accused, as such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail but is unable to refute such contention that there has been no recovery from the possession of the present petitioner and it has been only the statement of the co-accused for which the petitioner has been implicated in the present case. 2 Learned advocate for the State is also unable to apprise the court as to whether there are any previous antecedents of the present petitioner and/or call data records or/ money trail.
Having considered the same, I am of the opinion that further custodial detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Bipul Dey shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/-(Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 3rd Court, Dakshin Dinajpur. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1681 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. 3 Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
