31.07.2026 Serial no. 32 [G.S.D] CRM (A) 1622 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Kaliachak PS Case No. 1956 of 2025 dated 25.11.2025 u/s 21(c)/27A/29 of the NDPS Act [PTN No. 1824 of 2025]. -And- In the matter of : Md Abdur Rahim @ Rahim Sk … Petitioner(s) Md. Wasim Akram Ms. S. Parveen … for the petitioner(s) Mr. Pinaki Bhattacharyya, Sr Govt. Adv. Mr. Neel Chakaborty … for the State-respondent(s) Report submitted by the Investigating Officer of the case be kept with the record. The report reflects that there are no criminal antecedents and/or any Call Date Records and/or any money trail is available so far as the present petitioner is concerned. However, there was recovery of 5 kg of brown sugar in the present case in respect of the two seizures being effected and the complicity of the present petitioner as is reflected is primarily on the basis of statement of a co-2 accused. Charge-sheet has already been submitted before the learned jurisdictional court. Having regard to the same, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed.
Accordingly, I direct that in the event of arrest, the petitioner [Md Abdur Rahim @ Rahim Sk] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has been submitted before the learned jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 1622 of 2026 is disposed of. Report submitted by the State be also kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.) 3
