29.07.2026 Court No.35 Item No.74 ssi CRM (NDPS) 1490 of 2026 In Re: - An application for bail under Section 483 of the Bharatiya Suraksha Nagarik Sanhita in connection with NDPS Case No. 65 of 2024 arising out of English Bazar Police Station Case No. 1156 of 2024 dated 18.08.2024 under Sections 21 ( C)/29 of the NDPS Act. And In the matter of: Md. Serajul Hoque @ Sirajul Hoque …. Petitioner. Mr. Yuvraj Chatterjee Mr. Saikat Guin Ms. Mamotaj Parvin Mr. Rahul Surtani …for the petitioner Mr. Anirudha Sarkar ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since August 2024 for a period of 1 year 11 months. There has been alleged recovery of four packets containing 300 grams of brown sugar. Prosecution intends to examine 11 witnesses out of which 2 witnesses have been examined. Learned counsel appearing on behalf of the State opposes the prayer for bail. I have taken into account the chemical examiner’s report which reflects the presence of Diacetylmorphine (Heroin), 6-Monoacetylmorphine, Morphine3-acetate, Acetylcodeine, Morphine and Codeine. Having considered that the bail was granted principally on the judgment of the Hon’ble Supreme Court in SLP (Crl.) No. 13987 of 2025 (Sentu Seikh vs. State of West Bengal), I am inclined to release the petitioner on bail. 2
Accordingly, the petitioner, namely, Md. Serajul Hoque @ Sirajul Hoque shall be released on bail upon furnishing bond of Rs. 20,000/-(Rupees Twenty Thousand only) with two sureties of Rs. 10,000/-each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court and shall not leave the district of Malda without prior permission of the learned special Court. Thus, CRM (NDPS) 1490 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
