D/L66 10.07.2026 Bpg. C.R.M. (NDPS)821 of 2026 Allowed In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Balurghat Police Station Case No.454 of 2025 dated 10.07.2025 under Section 21(c)/22(c)/23(c)/25/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985; Nasim Sarkar @ Nasim Rejvi @ Sarkar Versus The State of West Bengal Mr. Ayan Bhattacharjee Mr. Kaushik Choudhury Mr. Dwaipayan Panda. …for the petitioner. Mr. Gouranga Kumar Das Mr. P. Karan Singh. …for the State. Mr. Gouranga Kumar Das, learned Additional Public Prosecutor along with Mr. P. Karan Singh, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 10 months, charge-sheet has been submitted, petitioner has been implicated on the basis of the statement of the co-accused and there has been no recovery from the present petitioner. Similarly placed accused person has been granted bail. Learned advocate for the State opposes the prayer for bail. 2 I have taken into account the locus of the present petitioner in respect of the other accused who has been granted bail.
Having considered that Jashim Uddin Sarkar is similarly placed as the petitioner, I am inclined to release the petitioner on bail. As such, the petitioner, namely, Nasim Sarkar @ Nasim Rejvi @ Sarkar be released on bail on same terms and conditions by the learned trial court as was imposed upon Jashim Uddin Sarkar in CRM(NDPS)735 of 2026. Thus, CRM(NDPS)821 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
