—(1) Whoever fails to comply with or contravenes any provision of this Act or the rules made, or orders issued, thereunder shall be guilty of an offence and shall, in respect of each such failure or contravention, be punished with imprisonment for a term which may extend to three years or with fine which may extend to one lac rupees or with both and, in case such failure or contravention continues, with an additional fine which may extend up to five thousand rupees for every day during which such failure or contravention continues after the conviction for first such failure or contravention.

Every such offence shall be cognizable and non-bailable.
