- In case of any breach of these rules or of the condition of the license or in case of any attempt by altering the capacities of receptacles or otherwise deceive the officer-in-charge in gauging or proving, either by the licensee or by any person in his employment, it shall be competent for the Excise Commissioner to impose upon him, in lieu of cancellation of the license a fine under section 76 of the Act.
