A tenant, other than a non-occupancy tenant, who pays fixed money rent may plant on his Molding any tree: Provided that-- (a) he shall not plant any tree in such a way as to diminish the value of any land, not included in his holding; and (b) he shall, in the absence of a written agreement to the contrary, continue to be liable to pay the full rent of the holding.
