(1)

The police shall take temporary charge,—

(a) of all unclaimed property found by or made over to them; and

(b) of all property found lying in any public street, if the owner or person in charge of such property on being directed to remove the same, refuses or omits to do so.

(2)

The taking of temporary charge of any property under sub-section (1) shall be forthwith reported to a Judicial Magistrate and the procedure laid down in sections 457, 458 and 459 of the Code of Criminal Procedure 1973, shall be applicable in respect of the disposal of such property as if it were property seized by a Police Officer under the said Code.
