- Subject to the provisions of sub-section (2), no person shall issue an Electronic Signature Certificate unless he holds a licence issued for that purpose by the Controller.
- A licence issued under sub-section (1) shall—
- be valid for such period as may be prescribed by the Central Government;
- not be transferable or heritable;
- be subject to such terms and conditions as may be specified in the licence.
- No licence shall be issued under sub-section (1), unless the applicant fulfils such conditions regarding qualification, expertise, manpower, financial resources and other infrastructure facility, which are necessary to issue Electronic Signature Certificates as may be prescribed by the Central Government.
- A licence granted under this section may be renewed in such manner as may be prescribed by the Central Government.
