-C. Grant of transmission license by the Central Government .-(1) Until the Central Commission is established, the Central Government and thereafter the Central Commission may, subject to the provisions of sub-section (4), grant a transmission license to any person.
(2)
A transmission license granted under sub-section (1) may authorise the transmission licensee to construct, maintain and operate any inter-State transmission system under the direction, control and supervision of the Central Transmission Utility.
(3)
Every application under sub-section (1) shall be-
(a) subject to such terms and conditions;
(b) in such form; and
(c) accompanied by such fees, as may be notified by the Central Government or by the Central Commission, as the case may be, in this behalf.
(4)
No application shall be entertained under sub-section (1) unless the applicant has obtained the approval of the Central Transmission Utility in such manner as may be notified by the Central Government or by the Central Commission, as the case may be, in this behalf.
(5)
Until the Central Commission is established, the Central Government and thereafter the Central Commission in the case of inter-State transmission system may, if it considers necessary in public interest, by order subject to such conditions, if any, as may be specified in that order, grant exemption to any person obtaining a transmission license under this section.
