Without the written permission of the Commissioner no building, wall or other structure shall be newly erected over any drain.

If any building, wall or other structure be so erected, the Commissioner, after giving the offending person ten days' notice of his intention, may [* * *] remove or otherwise deal with the same as he shall think fit, and the expenses thereby incurred shall be paid by the person offending.]
