(1)

Any person who, having been appointed as a Member of the Brihan Mumbai Electric Supply and Transport Committee,-

(a) becomes disqualified for being a Member of the Committee under the provisions of sub-section (5) of section 50; or

(b) absents himself during six successive meeting of the committee except from temporary illness or other causes to be approved by the committee; or

(c) absents himself from or is unable to attend the meeting of the committee during six successive months from any cause whatsoever, shall cease to be a Member of the Committee and his office shall thereupon become vacant.

If any question or dispute arises whether a vacancy has occurred under sub-section (1), the Commissioner shall, at the request of the Corporation, apply to the Chief Judge of the Small Cause Court, and the said Chief Judge, after making such inquiry as he deems necessary shall determine whether a vacancy has occurred, and his decision shall be final.
